They should update their structure page and strike stuff like this:

The for-profit would be legally bound to pursue the Nonprofit’s mission, and carry out that mission by engaging in research, development, commercialization and other core operations. Throughout, OpenAI’s guiding principles of safety and broad benefit would be central to its approach.

And maybe a good ol' IRS audit to boot. From this vantage, it looks like a structural coop.

oh they can be 100% sincere about their humanitarian ideals. But investor RTO, need for revenue streams to cover expenses, general market forces - these will always outstrip and determine the final cause of a company. Ideals don't matter, eventually, at most, PR in the service of expanding market share, intentionally or not.
