Yup, but that line was crossed when he federalized National Guard troops for domestic policing. Federalized National Guard troops are legally the same as active duty military, both are title 10 troops and are restricted in their domestic use to the same degree. There is legally no difference between federalized National Guard and any active duty military, including tier one special forces as far as posse comitatus. This is a flagrant and illegal abuse of emergency powers.

Nope, but using active military is no different than federalized National Guard. Both are title 10 troops and the use of either is the same under under Posse Comitatus. This is already Martial Law.

Defense Secretary Pete Hegseth said in a post on X that the Defense Department is "mobilizing the National Guard IMMEDIATELY to support federal law enforcement in Los Angeles. And, if violence continues, active duty Marines at Camp Pendleton will also be mobilized — they are on high alert." ~ABC News

States giving up their military power was a mistake. States need to rebuild and restore their State Guards/State Defense Forces. The ability to federalize the National Guard removes its ability to function as the State Militias that it replaced.

That is illegal. This is a flagrant violation of The Posse Comitatus Act. National Guard are considered Title 10 troops while federalized. Title 10 troops cannot be used for domestic policing except to suppress an active invasion or rebellion.

If he is allowed to do this, there is nothing stopping him from using the full Federal military in the same way. This is Martial Law, whether they bother to announce it or not. Get ready.

Just Nationalizing his companies without compensation would do it. Most of musk's wealth is in his companies and he just takes out loans using shares as collateral.
