Illinois-based musician Anthony Martino is suing the Internet Archive for copyright infringement over its Myspace Dragon Hoard collection. This 490,000 MP3 collection was created from recordings that were lost in Myspace's 2019 server disaster. According to Martino, his music ended up in the collection without his authorization. Meanwhile, the Internet Archive denies wrongdoing and says it is protected by the DMCA safe harbor.

Whoah, the collection wasn't lost forever? According to the archive.org info, it was all lost in 2018 during a 'botched server migration'. Would be amazing if most of it has survived due to this research project ...

If they say it's being used to train AI, and then refer to the Facebook case, should work out for them.

Um, although I don't want to cast aspersions based on my own ignorance — who the hell even is Anthony Martino? Is this his first shot at actually making money off his music, by suing a nonprofit?

I will say I did the most basic research into the guy, and according to his wikipedia entry his songs have been featured in some TV shows. Wikipedia also notes that "It is proposed that this article be deleted because of the following concern:lack of notability. Tony seems to have created pages for himself and related projects", so draw your own conclusions.
