so if it's random and you always complain when it's less then you just got a small raise
I imagined it as both. No, it's not legal, at least where I live, to keep overpayment if they ask for it back within the statute of limitations.
meanwhile, wage theft is the largest form is theft in the country, eclipsing all other forms of theft combined, and it's a pain to fight it.
The employee gets the exact same access to the legal system as the company both in general and specifically for the purposes of suing for theft.
