Have to? No they donโ€™t. Do they think we are stupid? They want to. The CLOUD Act mentioned in the article only applies to data created by US citizens.

In fact the main purpose of the act was to allow the executive branch to enter into information sharing agreements with said countries to bypass warrants here in the US. If you are a US citizen using a mail service with for instance EU based servers there is less protection legally for your emails.

"Would have" as in past tense?

"Would have to", "would go", "would be", are all in subjective form.

So that's like "would be required" since "I have to go" is like "I must go"; just, with that sentence form, 'must' is hard to easily swap-in.
