It's the same as in South Korea, it's their app which doesn't want to follow local data protection laws.
The model itself is open source and you can download it free of charge and run it on your own hardware offline without sending anything back 'home'.
It's a potty that there is only one name for both their app and the model which makes it confusing reading such headlines.
