The premise that one can force their will upon others just because they do not speak up (aka are silent) is unlawful. My silence does not constitute my consent. And neither does yours.

In Law when someone makes a claim and you are silent the "Law" sees that as agreement by default eg. a Contract is formed https://en.wikipedia.org/wiki/Acquiescence
