I saw the body cam footage. While they definitely used excessive force when they beat him up, he resisted arrest and was being overall combative. When the cop asked him for his ids he says no and slams the door closed and locks it. (His window was broken so he was communicating by opening the door)
The cop showed amazing composure by not immediately breaking the window and pulling him out. If that would have happened imo it would have been justified.
The original intent of the stop was a headlight violation.
The problem with that is that it wasn't raining, invalidating the reason for the stop.
From that point forward, the interaction should have immediately stopped. Without PC for the headlight violation, the police had no authority to demand ID. Since they couldn't demand ID, they didn't have a reason to arrest. That invalidates the resisting charge.
Start to finish this was a crazy interaction and I hope every cop involved has a very happy get lynched in front of their families. :)
I am not arguing that point at all. His rights were 100% violated. But you and everyone else fail to make decisions based on reality.
Everyone knows police abuse is a problem. Would you rather be right or dead? Instead of complying and filing suit later, he decided to make a bad situation 100x worse. As I said based on his reaction in slamming the door it is 100% reasonable that the officer making the stop would fear for his life. Regardless that the stop was illegal, IN THAT MOMENT, the cop would have been justified in drawing his weapon. Thankfully he didn’t and the young man is alive.
How exactly would an officer fear for his life when a door was slammed specifically to put distance between the victim and the officer?
Go watch the tape bro. You don’t have to take my word for it. There is a reason you’re only seeing the perspective from inside the car on social media.
